We, the A2ZMEAL are basic interface between you and participating restaurants.
Our company name is A2ZMEAL i.e. we are A2ZMEAL, a brand of http://www.a2zmeal.com, unless otherwise changed by our will. You should be agree by these terms and conditions for ordering foods from our Website or by our Android and IOS mobile applications.
a. All prices are in India Rupees.
b. A2ZMEAL may give contract any part or parts of the Services that we provide to customer from time to time and we may assign any part or parts of our rights under these Terms and Conditions without customer’s consent or any requirement to notify.
c. We may alter or vary the Terms and Conditions at any time without notice to customers.
d. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision on the Website, these Terms and Conditions shall prevail.
e. If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.
f. The voucher/invoice calculation is subject to A2ZMEAL's discretion and may be altered at any time and without notice. The voucher/invoice can discount any/all of the components including food cost, taxes and fees and likewise.
3. Ordering foods
a. For ordering foods from this Website any contract for preparation of Foods is between you and participating restaurant, for the delivery of Foods or Services any contract is between you and A2ZMEAL.
b. Any order that you place from this Website is subject to availability of the product you ordered, delivery capacity and acceptance by us and the Participating Restaurant. When you place order online, we will send an email and SMS to confirm that we have received it. This email confirmation will be produced automatically for the confirmation of your order details. You must immediately inform us if any details are incorrect. The fact that you receive an automatic confirmation does not necessarily mean that either we or the Participating Restaurant will be able to deliver your order. After sending the confirmation email and sms we will check availability and delivery capacity.
c. After your order if the ordered foods available, the participating restaurant will accept the order and confirm it to you and A2ZMEAL by the text message (SMS) on your mobile number provided in the profile.
d. In the order confirmation message following detail will be provided –
Approximate delivery time specified by participating restaurants
Price of the foods delivery ordered
e. If the Food delivery and services are not available, A2ZMEAL will inform by SMS (text message) on your phone or by phone call.
4. Pricing and Payments
a. You must warrant that the credit or debit card details that you provide are for your own credit or debit card and there must be sufficient funds to make payments of ordered foods or services.
b. During contract of the a2zmelas with participating restaurant, participating restaurants list their food dishes, pricing and approximate delivery timings. During ordering if the price listed is not current and restaurant inform us immediately after placing the order, we will try our best effort to contact you immediately to inform about price difference and you can choose to cancel your order at that time.
c. All prices listed on our Website are correct at the time of contract and have been input as provided by the restaurant. While we always take care to keep them up to date, the final price charged to you by the restaurant can change at the time of delivery based on the latest menu and prices of the restaurant. We reserve the right to alter the menu/foods available for sale on the Website and to stop listing restaurants.
d. All types of taxes and levies taxes are being charged and determined by the Participating Restaurant. A2ZMEAL is collecting it with bill on behalf of such Participating Restaurant.
e. The amount of applicable taxes collected by A2ZMEAL is remitted directly to Participating Restaurants and A2ZMEAL does not retain any amounts thereof.
f. A2ZMEAL is not responsible for validating the legal sanctity of the applicable taxes and the manner of its applicability on behalf of the Participating Restaurant.
g. A2ZMEAL holds no responsibility for the legal correctness and validity of the levy of such taxes. The sole responsibility for any legal issue arising on the taxes shall reside with the Participating Restaurant.
h. The transaction of sale of food or food items is between Participating Restaurant and the customer, and accordingly, A2ZMEAL is not liable to charge or deposit any taxes applicable on such transaction
i. The final invoice with tax will be issued by the Participating Restaurant and delivered to the customer along with the order.
j. A2ZMEAL reserve the right to alter prices for delivery by A2ZMEAL or a third party provider assigned by us.
k. Payment has to be made in cash or, if available on the website, by online payment through credit, debit card or internet banking.
5. Delivery of Order
a. Delivery time displayed in the website and mobile Apps are approximate and may vary.
b. A2ZMEAL will take due care to deliver the order in timely manner but due to some external factors like traffic jam, etc. it may vary. If delivery is being made by Partner, it is the responsibility of Partner to deliver ordered food on timely manner.
c. In case of a late delivery, the delivery charge will neither be voided nor refunded by A2ZMEAL.
d. If customer fails to accept ordered food due to improper address, improper instructions, refusal to accept food, etc then such order shall be deemed to have been delivered to customer and all risks and responsibility in relation to such order shall pass to customer.
e. Partner Restaurants and we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
f. Please note that it might not be possible for Participating Restaurants to deliver to some locations. If this is the case, our Participating Restaurants or we will inform you using the contact details that you provide to us when you make your order and arrange for cancellation of the order or delivery to an alternative delivery address.
6. Cancellation of Order and Refund
a. Customer must notify the partner restaurant immediately if decide to cancel order, preferably by phone, by intimating order number. If the restaurant accepts your cancellation, no cancellation fee applies. If the restaurant refuses cancellation, e.g. because preparation of Food has been completed and/or delivery personnel has already been dispatched, it may not be cancelled. We will not be able to refund any order, which has been already dispatched.
b. A2ZMEAL may cancel an order if the product is not available for any reason. We will notify customer if this is the case and return any payment that made.
c. If the cancellation was made in time and once the restaurant has accepted cancellation, A2ZMEAL will refund or re-credit your debit or credit card with the full amount within 14 days.
d. In the event that the Partner Restaurant delivers a wrong item, customer has the right to reject the delivery of the wrong item and customer shall be fully refunded for the missing item. We are not responsible for wrong or partial delivery. The issue has to be settled directly with the Participating Restaurant.
7. Customer Information
a. It is the responsibility of the customer to provide accurate information like address, mobile number etc for your order to process for delivery.
b. Customers are entitled to request a copy of the personal information we hold on you. Please contact us if you wish to request this information.
We take complaints very seriously and aim to respond to your complaints within 5 business days. All complaints should be addressed email@example.com.
